Consumer Terms (Customer / Traveller)

Terms for travellers who discover, compare, request, reserve or book tourism products and services through TryBookAfrica.

Consumer Terms (Customer / Traveller)

1. Purpose and acceptance

These Customer / Traveller Terms govern your use of TryBookAfrica.com to discover, compare, request, reserve or book tourism products and related services. By using the Platform, creating an Account, submitting a booking request or completing a Booking, you agree to these Terms, the booking-specific terms displayed before purchase, and any supplier terms made available to you.

Where a law gives you rights that cannot be excluded or limited, those rights continue to apply. If a country-specific addendum applies to your transaction, it prevails to the extent required by mandatory local law.

2. TryBookAfrica's role

TryBookAfrica is an African digital tourism marketplace and technology platform. Depending on the Product and transaction, TryBookAfrica may provide discovery, comparison, booking facilitation, payment facilitation, customer support or other disclosed services. Unless expressly stated otherwise, the tourism service itself is supplied by an independent Supplier. The exact contracting relationship is identified in the booking flow and/or Booking Confirmation.

3. Eligibility and traveller responsibility

  • You must be legally capable of entering the transaction. Where a Product has a minimum age or other eligibility condition, that requirement applies.

  • You must provide accurate and complete traveller, contact and booking information and keep it current.

  • You are responsible for passports, visas, entry permissions, health requirements, permits and other travel documents, unless the Product expressly includes assistance with them.

  • You must ensure that all travellers in your party have agreed to the relevant use of their personal information where required by applicable law.

4. Search, comparison and recommendations

Search results, ranking, availability, recommendations and displayed information are provided to assist decision-making. Rankings may reflect relevance, availability, commercial arrangements, quality signals, traveller feedback and other operational criteria. A listing, ranking, badge or recommendation does not by itself constitute a guarantee or endorsement of the Supplier.

5. Booking formation

A Booking becomes binding when the booking route expressly states that it is confirmed and a Booking Confirmation is issued or the applicable Supplier accepts the reservation. A booking request, enquiry or provisional hold is not necessarily a confirmed Booking. The booking-specific terms, price, inclusions, exclusions, cancellation rules, payment requirements and Supplier conditions form part of the Booking contract.

6. Prices, taxes, currency and charges

Prices displayed on the TryBookAfrica Platform shall be expressed in the currency indicated for the relevant listing or transaction and shall be subject to availability, applicable taxes, service charges, tourism levies and other mandatory charges. Any additional charges payable by the Traveller shall be disclosed before the booking is confirmed, to the extent required by applicable law.

Currency Conversion: Where a Supplier’s prices are displayed in a currency different from the currency in which the Traveller will be charged, any converted price displayed on the Platform shall be treated as an estimate for convenience only, unless the checkout expressly identifies the converted amount as the final amount payable. The actual amount charged may differ due to the applicable exchange rate, the time of conversion, and any foreign-exchange fees or charges imposed by the relevant payment service provider, card issuer or financial institution.

Where a transaction is processed in a currency different from the Traveller’s payment-account currency, the Traveller may be charged additional conversion fees by their payment service provider, card issuer or financial institution. Such charges may be outside TryBookAfrica’s control.

Supplier Pricing and Currency: Suppliers are responsible for ensuring that their listed prices, currency selections, taxes and additional charges are accurate and kept up to date. Where the Platform requires a Supplier to submit prices in a designated currency, the Supplier must comply with the applicable listing requirements. Any conversion used by a Supplier to determine its listed price does not, by itself, establish a guaranteed exchange rate or a right to receive settlement in another currency.

Pricing Errors: TryBookAfrica reserves the right to investigate and correct obvious pricing or currency-display errors, subject to applicable law. Where an error materially affects a booking, TryBookAfrica will take reasonable steps to notify the affected Traveller and Supplier and, where appropriate, offer cancellation, a refund or another lawful resolution. TryBookAfrica will not rely on this provision to avoid obligations that cannot lawfully be excluded.

7. Payment

Payments for Products booked through the TryBookAfrica Platform shall be processed using the payment arrangements made available for the relevant Product. Depending on the applicable arrangement, payment may be processed by an authorised payment service provider, collected directly by the Supplier, or facilitated through another duly authorised payment intermediary.

TryBookAfrica shall facilitate or undertake the collection, receipt, holding, transfer or disbursement of payments only to the extent permitted by applicable law and once any required registration, authorisation, sponsorship or other regulatory arrangements have been satisfied.

The applicable payment method, payment recipient, currency, timing, fees and refund arrangements shall be disclosed to the Traveller during checkout or before the booking is confirmed, as applicable.

Where payment is processed by a third-party payment service provider, the Traveller may be redirected to, or provided with, an authorised payment interface. Payment card details and other payment credentials should be entered only through the designated secure payment interface.

The processing of payments, settlement of funds, payment of Supplier proceeds, collection of commissions, and administration of refunds and chargebacks shall be governed by the applicable booking terms, Supplier Agreement, Commercial Terms and payment-provider arrangements.

Nothing in this clause shall be interpreted as authorising TryBookAfrica to conduct a regulated payment activity for which a registration, authorisation or other approval is required but has not been obtained.

8. Cancellation, amendment, no-show and refunds

Your rights depend on the Product, Supplier policy, booking route and mandatory law. The Cancellation & Refund Policy forms part of these Terms. Unless mandatory law provides otherwise, a cancellation is governed by the cancellation policy presented before Booking. Refunds may be subject to Supplier funding, payment-provider processing and permitted deductions.

9. Supplier cancellation or service failure

If a Supplier cancels, materially changes, cannot honour a confirmed Booking or fails to provide the Product, TryBookAfrica may assist with an alternative, relocation, rescheduling or refund process as appropriate to the transaction. Remedies remain subject to the Supplier contract and applicable law.

10. Safety, health and special requirements

Tourism products can involve transport, wildlife, water, altitude, outdoor activities, food, alcohol, equipment and other inherent risks. Suppliers are responsible for lawful and reasonable safety measures applicable to their Products. Travellers must disclose relevant accessibility or other requirements where the booking flow asks for them and should confirm suitability directly with the Supplier where necessary.

11. Reviews and content

Reviews should be honest, relevant and based on genuine experience. We may moderate or remove content that is unlawful, fraudulent, defamatory, discriminatory, threatening, misleading, privacy-invasive or otherwise inconsistent with our content standards. By uploading content, you confirm you have the required rights and permissions and grant TryBookAfrica a non-exclusive licence to host, reproduce, adapt and display that content for operating, improving and marketing the Platform, subject to applicable law.

12. Acceptable use

  • Do not make fraudulent, speculative or abusive bookings.

  • Do not impersonate another person or misrepresent identity or authority.

  • Do not use scraping, automated extraction, bots or automated booking tools except where TryBookAfrica expressly authorises the activity.

  • Do not upload malware, unlawful material or content that infringes third-party rights.

  • Do not attempt to bypass security, payment controls, verification or access restrictions.

13. Privacy

Personal information is processed in accordance with the TryBookAfrica Privacy Policy and applicable data-protection law. Where cross-border processing occurs, the safeguards and transfer rules required by applicable law will apply.

14. Complaints and dispute resolution

Please report problems promptly through the official TryBookAfrica support channel. Where the problem concerns Supplier performance, we may involve the Supplier. Nothing prevents you from using any statutory court, tribunal, regulator, ombud or alternative dispute-resolution mechanism available to you under mandatory local law.

15. Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful. Subject to mandatory law, TryBookAfrica is not responsible for the independent acts, omissions, insolvency, safety practices or service performance of a Supplier except to the extent TryBookAfrica has expressly assumed the relevant responsibility or has itself breached a legal duty. Any permitted limitation of liability will be interpreted narrowly and consistently with applicable consumer-protection law.

16. Governing law and country addenda

The Platform relationship is intended to be governed by South African law, but each Booking remains subject to mandatory laws of the relevant country, place of service and consumer jurisdiction. A country-specific addendum may modify these Terms where required.
